Legal Entity These Terms of Service constitute a legal agreement between you and OM Capital LTD (trading as "AstroAnimal"), a company registered in England and Wales (Company Number: 13791958), with its registered office at 167-169 Great Portland Street, 5th Floor, London, England, W1W 5PF.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the AstroAnimal mobile application ("App"), website, and all related services, content, and features (collectively, the "Service"). In these Terms, "AstroAnimal," "we," "us," and "our" refer to OM Capital LTD, and "you" and "your" refer to any user of the Service.

By creating an account, downloading the App, or using the Service in any way, you represent and warrant that:

2. Eligibility and Age Requirements

The Service has different age requirements depending on how you use it:

You must be at least 13 years of age (or 16 in the EU/EEA) to access and use the free features of the Service.

2.2 Paid Features

You must be at least 18 years of age to purchase subscriptions or make in-app purchases through the Service.

2.3 Parental Consent

If you are under 18 years of age, you must have your parent or legal guardian review and agree to these Terms on your behalf before using the Service.

2.4 Geographic Restrictions

You must not access or use the Service if you are located in a country that is subject to a UK or US government embargo, or that has been designated by the UK or US government as a "terrorist supporting" country. You confirm that you are not listed on any UK or US government list of prohibited or restricted parties.

3. Description of Service

AstroAnimal provides personalized astrological content and readings for pets based on birth information, breed, and other characteristics. The Service includes:

THE SERVICE IS PROVIDED FOR ENTERTAINMENT PURPOSES ONLY. AstroAnimal provides astrological and spiritual content that is not based on scientific evidence. The readings, predictions, advice, and interpretations provided through the Service:

YOU SHOULD NOT MAKE DECISIONS ABOUT YOUR PET'S HEALTH, CARE, TRAINING, OR WELLBEING BASED SOLELY ON CONTENT PROVIDED THROUGH THE SERVICE. ALWAYS CONSULT WITH QUALIFIED VETERINARY PROFESSIONALS FOR ANY HEALTH OR BEHAVIORAL CONCERNS REGARDING YOUR PET.

EMERGENCY SITUATIONS: If your pet is experiencing a medical emergency, contact your veterinarian or emergency animal hospital immediately. Do not rely on the Service for emergency guidance.

4. User Accounts

4.1 Account Creation

To access certain features of the Service, you must create an account. When creating an account, you agree to:

You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to protect your account credentials. 4.3 One Account Per User

You may only maintain one account per email address. You may not create multiple accounts or share your account with others. You may not transfer or assign your account to another person.

5. Subscriptions and Payments

5.1 In-App Purchases

AstroAnimal offers a freemium model with certain features available through in-app purchases and subscriptions. All purchases are processed through the Apple App Store, Google Play Store, or other authorized payment platforms ("External Services").

5.2 Pricing

Prices for subscriptions and in-app purchases are displayed in the App and are subject to change at any time. We will notify you of any price changes before they take effect. Prices include applicable taxes unless otherwise stated.

5.3 Subscription Terms

If you purchase a subscription:

Payment will be charged to your Apple ID or Google Play account at confirmation of purchase. Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription price. You can manage and cancel your subscriptions at any time through your App Store or Google Play account settings after purchase. Any unused portion of a free trial period will be forfeited when you purchase a subscription.

5.4 Payment Processing

All payments are processed through External Services in accordance with their terms and conditions. We use RevenueCat to manage subscriptions and in-app purchases. By making a purchase, you agree to the terms of the applicable External Service.

5.5 Cancellation

You may cancel your subscription at any time through your External Service account settings:

Cancellation will take effect at the end of your current billing period. You will continue to have access to premium features until that time. Cancelling your subscription does not delete your account.

5.6 Refunds

All sales are final. Refund requests must be submitted through the External Service through which you made your purchase:

Refund policies are determined by the External Service, not by AstroAnimal. We have no control over whether a refund is granted.

5.7 No Guarantees

We do not guarantee that paid features will meet your expectations or that the Service will be error-free or uninterrupted. Purchasing a subscription does not guarantee specific results or outcomes.

5.8 Free Trials

Certain subscription plans include a free trial period (currently 7 days on annual plans). The duration of any free trial will be clearly stated at the time of sign-up. Your payment method will be charged at the price displayed at the time of purchase at the end of the free trial period unless you cancel before the trial ends. You must cancel through your App Store or Google Play account at least 24 hours before the end of the free trial period to avoid being charged. If you cancel during the free trial, you will continue to have access to premium features until the end of the trial period. We reserve the right to modify or discontinue free trial offers at any time.

5.9 App Store and Google Play Providers

You acknowledge and agree that:

Apple Inc. and Google LLC are third-party beneficiaries of these Terms and, upon your acceptance of these Terms, each of Apple Inc. and Google LLC will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

6. User Content

6.1 Your Content

The Service allows you to upload, submit, store, and share content, including photographs of your pets, profile information, and other materials (collectively, "User Content"). You retain ownership of your User Content, but you grant us certain rights as described below.

6.2 License to Your Content

By submitting User Content to the Service, you grant AstroAnimal a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display your User Content in connection with operating and providing the Service, including:

This license exists only for the purpose of operating and improving the Service and ends when you delete your User Content or account, except where content has been shared with others or is required for legal purposes.

6.3 Representations and Warranties

By submitting User Content, you represent and warrant that:

6.5 Monitoring and Removal

We reserve the right, but have no obligation, to monitor, review, or remove User Content at any time and for any reason, including if we believe it violates these Terms or may harm the Service, our users, or third parties. 6.6 Backup Your Content

You are solely responsible for maintaining backups of your User Content. We are not responsible for any loss, corruption, or deletion of User Content.

7. Social Sharing

The Service allows you to share content on social media platforms such as Instagram, TikTok, Facebook, and others. When you share content:

8. User Feedback and Suggestions

All Feedback, once submitted, becomes the sole and exclusive property of AstroAnimal. You hereby assign to us all right, title, and interest in and to all Feedback, including all intellectual property rights therein.

8.5 Waiver

You irrevocably waive any claims, including moral rights, that you may have in connection with any Feedback you submit, including any claim to compensation, credit, or acknowledgment.

9. Intellectual Property Rights

9.1 AstroAnimal's Rights

The Service and all of its content, features, and functionality (including but not limited to software, text, displays, images, graphics, design, user interface, look and feel, data compilations, and AI-generated content) are owned by AstroAnimal, its licensors, or other content providers and are protected by United Kingdom and international copyright, trademark, patent, trade secret, and other intellectual property laws.

9.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial use only. This license does not include any right to:

The AstroAnimal name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of OM Capital LTD. You may not use these marks without our prior written permission.

9.4 AI-Generated Content

Content generated by the Service using artificial intelligence (including astrological readings and interpretations) is owned by AstroAnimal. You may use this content for personal purposes but may not commercially exploit it without our written permission.

10. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ASTROANIMAL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

ASTROANIMAL IS NOT A SUBSTITUTE FOR PROFESSIONAL ADVICE. The Service does not provide veterinary, medical, legal, financial, or other professional advice. Any information or content provided through the Service is for entertainment purposes only. You should not rely on the Service for decisions affecting your pet's health, wellbeing, or care.

16.3 Third-Party Content

The Service may include content provided by third parties, including other users, artificial intelligence systems, and external data sources. We are not responsible for and do not endorse any third-party content. We make no representations or warranties about the accuracy, reliability, or appropriateness of third-party content.

16.4 Technical Issues

We do not warrant that the Service will be free from bugs, viruses, or other harmful components, or that your use of the Service will be secure. You are responsible for implementing safeguards to protect your data and devices.

17. Limitation of Liability

17.1 EXCLUSION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ASTROANIMAL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

17.2 Cap on Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM; OR (B) 50 GBP.

17.3 Basis of the Bargain

The limitations in this section reflect the allocation of risk between you and AstroAnimal and are a fundamental basis of the bargain between us. These limitations will apply even if any limited remedy fails of its essential purpose.

17.4 Statutory Rights and Jurisdictional Variations

Nothing in these Terms shall limit or exclude our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any liability which cannot be limited or excluded under applicable law, including under the UK Consumer Rights Act 2015 and applicable consumer protection laws.

If you are a consumer in the UK or EU, you may have statutory rights that these Terms cannot override. Nothing in these Terms is intended to affect those statutory rights. In other jurisdictions, the above limitations and exclusions will apply only to the extent permitted by applicable law.

18. Indemnification

You agree to indemnify, defend, and hold harmless AstroAnimal, OM Capital LTD, and their respective officers, directors, employees, agents, affiliates, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or related to:

20. Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.

21. Dispute Resolution

21.1 Informal Resolution

Before initiating any legal proceeding, you agree to first contact us at support@astroanimal.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute through good faith negotiations.

21.2 Arbitration Agreement

Except for disputes that qualify for small claims court and except as provided in Section 21.5, you and AstroAnimal agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (including the formation, performance, breach, or termination of these Terms) shall be finally resolved by binding individual arbitration under the rules of the London Court of International Arbitration (LCIA), with the seat of arbitration in London, England, and conducted in English. The arbitration shall be governed by the Arbitration Act 1996 and the Consumer Rights Act 2015 where applicable. You and AstroAnimal each waive the right to a trial by jury and the right to participate in any class action, class arbitration, or other representative proceeding.

21.3 Arbitration Opt-Out

You may opt out of the arbitration agreement by sending written notice to support@astroanimal.com with the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms. Your notice must include your name and the email address associated with your account. If you opt out, disputes will be resolved pursuant to Section 21.4 below.

21.4 Jurisdiction (for opted-out users and small claims)

For users who have validly opted out of arbitration, or for disputes qualifying for small claims court, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales. You irrevocably submit to the jurisdiction of such courts and waive any objection to proceedings in such courts on the grounds of venue or inconvenient forum.

21.5 No Class Actions

WHETHER IN ARBITRATION OR IN COURT, YOU AND ASTROANIMAL AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and AstroAnimal agree otherwise, no arbitrator or judge may consolidate more than one person's claims or otherwise preside over any form of a representative or class proceeding.

21.6 Time Limit for Claims

You agree that any claim you may have arising out of or related to your relationship with AstroAnimal must be filed within one year after such claim arises; otherwise, your claim is permanently barred.

22. International Users

The Service is controlled and operated from the United Kingdom. If you access the Service from outside the UK, you are responsible for compliance with local laws in your jurisdiction. By using the Service, you consent to the transfer of your information to the UK and other countries where our service providers operate, which may have different data protection laws than your country of residence.

23. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

24. Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

25. Assignment

You may not assign, transfer, or delegate these Terms or your rights and obligations hereunder without our prior written consent. We may assign, transfer, or delegate these Terms and our rights and obligations without restriction. These Terms shall be binding upon and inure to the benefit of the parties and their respective successors and permitted assigns.

26. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or policies published by us on the Service, constitute the entire agreement between you and AstroAnimal regarding the Service and supersede all prior or contemporaneous understandings and agreements, whether written or oral, regarding the Service.

27. Survival

All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

28. Force Majeure

AstroAnimal shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemic, acts of government, war, terrorism, civil unrest, power failures, internet outages, third-party service disruptions (including failures of Firebase, OpenAI, Apple, Google, or other service providers), labor disputes, or any other cause beyond our reasonable control. In such circumstances, our obligations under these Terms will be suspended for the duration of the event.
